1 REPUBLJK ll'idonesia MEMORANDUM SALING PENGERTIAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH REPUBLIK DEMOKRATIK TIMOR-LESTE TENTANG KERJA SAMA BIDANG PERTANIAN Pemerintah Republik Indonesia yang diwakili oleh Kementerian Pertanian dan Pemerintah Republik Demokratik Timor-Leste yang diwakili oleh Kementerian Pertanian dan Perikanan, (selanjutnya secara individu disebut "Pihak" dan secara bersama-sama disebut sebagai "Para Pihak"), MENGINGAT semangat kerja sama bilateral yang sedang berlangsung di bidang pertanian, MENGINGINKAN untuk memperbaharui komitmen yang dibuat di bawah Memorandum Saling Pengertian antara Kementerian Pertanian Republik Indonesia dan Kementerian Pertanian dan Perikanan Republik Demokratik Timor-Leste tentang Kerja Sama Bidang Pertanian, ditandatangani di Jakarta, pada tanggal 29 Oktober 2008 dan arti pentingnya untuk meningkatkan kerja sama di bidang pertanian, MENEGASKAN bahwa kerjasama tersebut akan melayani kepentingan umum dan memberikan kontribusi bagi peningkatan pembangunan pertanian dan ekonomi kedua negara, BERDASARKAN pada hukum dan peraturan yang berlaku serta prosedur dan kebijakan dari masing-masing negara, 1

2 TELAH menyepakati hal-hal sebagai berikut: PASALI TUJUAN Tujuan dari Memorandum Saling Pengertian (selanjutnya disebut "MSP") ini adalah untuk memperluas kerangka kerja sama yang ada dengan mendorong pengembangan di bidang pertanian antara kedua PihaK termasuk melalui kerja sama teknik dan ilmiah, berdasarkan hukum dan peraturan yang berlaku di masing-masing negara. PASAL II BIDANG KERJA SAMA Bidang kerja sama yang disepakati antara Kedua Pihak sesuai dengan tujuan MSP ini terdiri dari: a) Peternakan; b) Perkarantinaan; c) Tanaman pangan; d) Tanaman lndustri; e) Kesehatan hewan; f) Spesies yang terancam punah; g) Standar kualitas dan keamanan produk pertanian dan hewan; h) Hortikultura; atau i) Bentuk kerja sama lainnya yang disepakati oleh Para Pihak. PASAL Ill BENTUK KERJA SAMA Bentuk-bentuk kerja sama untuk pelaksanaan MSP ini adalah: a) Kunjungan dan pertukaran ilmuwan, teknisi dan ahli lainnya; b) Pertemuan tingkat tenaga ahli; c) Pertukaran pengalaman,informasi ilmiah dan dokumentasi, melalui rapat teknis, seminar, lokakarya dan konferensi; d) Penelitian dan pelatihan bersama pada subjek yang menjadi kepentingan bersama; 2

3 e) Pengembangan dan pertukaran pengetahuan teknis; f) Penelitian dan pengembangan teknologi; g) Pengembangan kapasitas melalui program pelatihan; h) Penciptaan basis data spesies yang terancam punah; i) Studi bersama dan aktivitas untuk mencegah impor ilegal bahan hewan dan tanaman atau produk-produk pertanian melalui perbatasan darat. Aktivitas dimaksud haruslah tidak menjadi kegiatan penegakan hukum. j) Promosi bersama dalam pemasaran komoditas pertanian antara sektor swasta kedua negara; atau k) Bentuk lain dari kerja sama yang akan disepakati bersama secara tertulis oleh Para Pihak. PASAL IV IMPLEMENTASI DAN PELAKSANAAN 1. Para Pihak akan melaksanakan ketentuan MSP ini sesuai dengan undangundang, peraturan dan kebijakan yang berlaku dan sesuai dengan ketersediaan dana yang disediakan untuk tujuan ini. 2. Kerja sama disepakati dalam MSP ini akan dicapai dan ditetapkan dengan program khusus berdasarkan per kegiatan dan berdasarkan persetujuan pengaturan pelaksanaan khusus yang mendefinisikan ruang lingkup, tujuan, anggaran, kerangka waktu dan mekanisme pelaksanaan setiap program kerja sama yang telah disepakati oleh para pihak yang berwenang dan disetujui oleh anggota pemerintah yang relevan; 3. Pihak berwenang yang ditunjuk dapat, dengan kesepakatan bersama, memperluas keikutsertan pada program tertentu kepada badan publik lainnya yang bekerja di bidang terkait, seperti di bidang lingkungan, kehutanan, perubahan iklim atau kesehatan, apabila tindakan tersebut mendatangkan manfaat untuk efisiensi pelaksanaan program; 4. Pihak berwenang yang ditunjuk akan menyiapkan laporan terkait dengan pelaksanaan program-program khusus di bawah MSP ini kepada anggota pemerintah yang terkait. 3

4 PASAL V PIHAK BERWENANG YANG DITUNJUK DAN KELOMPOK KERJA BERSAMA BIDANG PERT ANIAN 1. Pihak berwenang yang ditunjuk untuk melakukan koordinasi, pelaksanaan, pengawasan dan evaluasi dari pelaksanaan MSP ini adalah: untuk Republik Indonesia, Pusat Kerja Sama Luar Negeri, Kementerian Pertanian; untuk Republik Demokratik Timor-Leste, Sekretaris Jenderal Kementerian Pertanian dan Perikanan. 2. Para Pihak sepakat untuk membentuk Kelompok Kerja Bersama Bidang Pertanian (selanjutnya disebut "JAWG") untuk pelaksanaan MSP ini, yang terdiri dari pejabat tinggi dari istitusi terkait yang disebutkan pada ayat sebelumnya. 3. JAWG akan bertemu secara berkala dan bergantian di Indonesia atau di Timor-Leste setidaknya sekali setiap dua tahun. 4. JAWG bertanggung jawab untuk melaksanakan kegiatan umum yang disebutkan dalam ayat 1 dan bertanggung jawab untuk: a. Pengembangan dari pelaksanaan kegiatan tertentu; b. Pembahasan lebih lanjut mengenai kegiatan kolaboratif yang akan dilakukan dan perkiraan anggaran; c. Berbagi informasi tentang kemajuan kerja sama serta mengevaluasi secara berkala pelaksanaan MSP ini; d. Mempersiapkan laporan ke Komisi Bersama Tingkat Menteri tentang Kerja Sama Bilateral antara Republik Indonesia dan Republik Demokratik Timor-Leste. PASAL VI PENGATURAN KEUANGAN 1. Kerja sama yang ditetapkan dalam MSP ini akan dilakukan dan disesuaikan pada ketersediaan dana dan personil dari Para Pihak serta sumber daya lainnya yang disepakati oleh Para Pihak. 2. Para Pihak akan saling menyetujui setiap pengaturan keuangan yang timbul dari setiap pelaksanaan kegiatan berdasarkan kasus-per kasus. 4

5 PASAL VII KEWAJIBAN Para Pihak bertanggung jawab agar berupaya sebaik-baiknya untuk: a) Menjamin bahwa semua personil, langsung atau tidak langsung terlibat dalam kegiatan yang dilakukan di bawah MSP ini, yang berhubungan dengan informasi rahasia, tidak membocorkan informasi tersebut kepada pihak ketiga, kecuali jika disepakati secara tertulis oleh Para Pihak; b) Menekan dan melakukan tindakan melawan segala bentuk perdagangan ilegal produk pertanian dan hewan dari pihak lainnya, sesuai dengan hukum dan peraturan yang berlaku. c) Setiap warga negara dari pihak yang melakukan kegiatan di bawah MSP ini di wilayah Pihak lainnya harus menghormati dan tidak mengganggu kemerdekaan politik, kedaulatan, dan keutuhan wilayah kedua negara, dan menghindari kegiatan yang tidak sesuai dengan maksud dan tujuan dari MSP ini. PASAL VIII SUMBER DAYA GENETIK 1. Para Pihak menegaskan bahwa akses ke sumber daya genetik harus dilakukan sesuai dengan ketentuan-ketentuan Konvensi Keanekaragaman Hayati, 1992 dan Perjanjian mengenai Sumber Daya Genetik Tanaman untuk Pangan dan Pertanian, 2001, khususnya prinsip-prinsip persetujuan sebelumnya dan pembagian keuntungan yang adil dan merata. 2. Masing-masing Pihak berwenang untuk menentukan akses ke sumber daya genetik sesuai dengan peraturan nasional dan berupaya menciptakan kondisi untuk memfasilitasi akses yang transparan ke sumber daya genetik. PASAL IX PERJANJIAN TRANSFER MATERIAL 1. Setiap kegiatan berdasarkan MSP ini, yang memerlukan akses ke sumber daya genetik, harus dilakukan sesuai dengan peraturan nasional negara penyedia dan dengan menghormati prinsip pembagian keuntungan dan 5

6 persetujuan sebelumnya. 2. Semua bahan penelitian yang digunakan dalam kolaborasi, jika diperlukan oleh hukum masing-masing. peraturan dan kebijakan dari Pihak. akan ditransfer menggunakan Perjanjian Transfer Material (dalam hal ini disebut "MTA"). 3. Syarat dan kondisi dari MTA akan ditangani pada kasus per kasus diantara Pihak. PASAL X PARTISIPASI PIHAK KETIGA Salah satu Pihak dapat mengundang partisipasi pihak ketiga dalam proyekproyek dan I atau program bersama yang dilakukan di bawah MSP ini setelah mendapat persetujuan dari Pihak lainnya. Dalam melaksanakan proyek-proyek dan I atau program bersama tersebut, para pihak harus memastikan bahwa pihak ketiga harus memenuhi ketentuan MSP ini. PASAL XI PENYELESAIAN PERBEDAAN Setiap perselisihan atau perbedaan yang mungkin timbul sehubungan dengan interpretasi atau penerapan MSP ini akan diselesaikan dengan cara konsultasi atau negosiasi diantara Para Pihak. PASAL XII KEPEMILIKAN HAK INTELEKTUAL DAN INDUSTRI 1. Semua kepemilikan hak intelektual dan industri yang dimiliki oleh satu Pihak dan digunakan untuk pelaksanaan MSP ini akan tetap menjadi milik Pihak dimaksud. 2. Semua kepemilikan hak intelektual dan industri yang muncul di bawah pelaksanaan MSP ini, berupa penemuan atau inovasi ilmiah, harus dimiliki dan dibagi secara adil antara Para Pihak sesuai dengan perjanjian khusus mengenai hal ini. 6

7 PASAL XIII AMAN DEM EN MSP ini dapat diubah setiap saat melalui persetujuan bersama dari Para Pihak.secara tertulis. PASAL XIV MULAI BERLAKU, MASA BERLAKU DAN AKHIR MASA BERLAKU 1. MSP ini mulai berlaku pada tanggal penandatanganan. 2. MSP ini akan tetap berlaku untuk jangka waktu lima (5) tahun, kecuali disetujui untuk diperpanjang oleh Pihak secara tertulis paling lambat enam (6) bulan sebelum berakhirnya. 3. MSP ini dapat diakhiri oleh kedua Pihak setiap saat, dan dapat diakhiri oleh salah satu Pihak melalui pemberitahuan secara tertulis kepada Pihak lain tiga (3) bulan sebelum waktu yang diinginkain untuk penghentian. 4. Kecuali diperjanjikan lain, penghentian MSP ini tidak akan mempengaruhi keabsahan dan masa berlakunya setiap pengaturan yang sedang berlangsung, kegiatan dan kontrak yang dibuat di bawah MSP ini sampai penyelesaian pengaturan, kegiatan dan kontrak dimaksud; 5. Pemutusan MSP ini tidak akan melepaskan Pihak dari pelaksanaan kewajiban yang dihasilkan dari ketentuan MSP ini mengenai keamanan informasi dan penyelesaian perbedaan. 6. MSP ini akan menggantikan Memorandum Saling Pengertian antara Kementerian Pertanian Republik Indonesia dan Kementerian Pertanian Republik Demokratik Timor-Leste mengenai Kerja Sama Pertanian, yang ditandatangani di Jakarta, pada tanggal 29 Oktober

IIVDONESIA MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF TIMOR LESTE ON AGRICULTURAL COOPERATION The Government of the Republic of Indonesia, represented by the Ministry of Agriculture, and the Government of the Democratic Republic of Timor-Leste, represented by the Ministry of Agriculture and Fisheries (hereinafter referred to singularly as "the Party" and collectively as "the Parties"), CONSIDERING the spirit of the ongoing bilateral cooperation in the field of agriculture, DESIRING to renew the commitments made under the Memorandum. of Understanding between the Ministry of Agriculture of the Republic of Indonesia and the Ministry of Agriculture and Fisheries of the Democratic Republic of Timor-Leste on Agricultural Cooperation, signed in Jakarta, on the 29th of October of 2008 and its significance for enhancing cooperation in the field of agriculture, AFFIRMING that such cooperation would serve common interests and contribute to the enhancement of the agricultural and economic development of both countries, PURSUANT to the prevailing laws and regulations as well as procedures and policies of the respective countries, HAVE reached the following understanding: 1

17 ARTICLE I OBJECTIVE The objective of this Memorandum of Understanding (hereinafter referred to as "MoU") is to expand the existing framework of cooperation that encourages the development of agricultural sector between the Parties including through technical and scientific cooperation, pursuant to prevailing laws and regulations of the respective countries. ARTICLE II AREAS OF COOPERATION The areas of cooperation agreed between the Parties pursuant to the objective of this MoU may comprise of: a) Livestock; b) Quarantine; c) Food crops; d) Industrial plants; e) Animal health; f) Endangered species; g) Quality and safety standards of agricultural and animal produces; h) Horticulture; or i) Any other area of cooperation, which will be mutually agreed in writing by the Parties. ARTICLE Ill FORMS OF COOPERATION The forms of cooperation for the implementation of this MoU may be implemented through: a) Visits and exchanges of scientists, technicians and other experts; b) Meetings of working-level experts; c) Exchange of views. scientific information and documentation, through technical meetings, seminars, workshops and conferences; 2

18 d) Joint research and training on subjects of common interest; e) Development and exchange of technical know-how; f) Research and development of technology; g) Capacity building through training programs; h) Creation of an endangered species database; i) Joint study and activities to prevent illegal importation of animal and plant material or any agricultural produces especially through land borders. Such activities shall not amounted to law enforcement activities; j) Joint promotion in marketing of agriculture commodities between private sectors of both countries; or k) Any other form of cooperation, which will be mutually agreed in writing by the Parties. ARTICLE IV IMPLEMENTATION AND EXECUTION 1. The Parties shall implement the provisions of this MoU in accordance with the laws, regulations and policies to which they are subject and according to the availability of funds appropriated for this purpose. 2. The cooperation foreseen in this MoU shall be achieved and defined by specific programs on a case by case basis and pursuant to the adoption of specific implementing arrangements which define the scope, objectives, budget, timeframe and execution mechanisms of each cooperation program as agreed by the competent authorities and approved by the relevant government members. 3. The designated authorities may, by mutual agreement, extend the participation on specific programs to other public entities who work in related fields, such as environment, forestry, climate change or health, when such action provides an advantage for the efficiency of the program's implementation. 4. The designated authorities shall prepare reports regarding the execution of specific programs under this MoU to be submitted to the relevant government members. 3

19 ARTICLE V DESIGNATED AUTHORITIES AND JOINT AGRICULTURE WORKING GROUP 1. The designated authorities for the coordination, execution, monitoring and evaluation of the implementation of this MoU are: for the Republic of Indonesia, the Center of International Cooperation of the Ministry of Agriculture; for the Democratic Republic of Timor-Leste, the Secretary General of the Ministry of Agriculture and Fisheries. 2. The Parties decide to establish a Joint Agriculture Working Group (hereinafter referred to JAWG) for the implementation of this MoU, composed by senior officials of the relevant services mentioned in the previous paragraph. 3. The JAWG shall meet periodically and alternately in Indonesia or in Timor Leste at least once every two years. 4. The JAWG is responsible to carry out the general activities mentioned in paragraph 1 and is specially responsible for: a. The development of specific implementation arrangements; b. Further discussion regarding collaborative activities to be carried out and budget estimation; c. Sharing information on the progress of cooperation as well as evaluate periodically the implementation of this MoU; d. Preparing the reports to the Joint Ministerial Commission on Bilateral Cooperation between the Republic of Indonesia and the Democratic Republic of Timor-Leste. ARTICLE VI FINANCIAL ARRANGEMENTS 1. The cooperation set forth in this MoU shall be carried out subject to the availability of fund and personnel of the Parties as well as any other resources as agreed upon by the Parties. 2. The Parties shall mutually agree upon any financial arrangement arising from each implementing arrangement on a case-by-case basis. 4

20 ARTICLE VII OBLIGATIONS The Parties undertake the responsibility to use its best endeavours to: a) Guarantee that all personnel, directly or indirectly involved in any activities carried out under this MoU, that in contact with confidential information, do not divulge such information to third parties, unless agreed otherwise in writing by the Parties; b) Repress and act against any form of illegal trade of agricultural and animal produces from the other Party within its territory, pursuant to the applicable laws and regulations. c) Any nationals of a Party engaged in activities under this MoU in the territory of the other Party shall respect and not interfere with the political independence, sovereignty, and territorial integrity of the latter, and avoid any activities inconsistent with the purpose and objectives of this MoU. ARTICLE VIII GENETIC RESOURCES 1. The Parties reaffirm that access to genetic resources shall be carried out in accordance with the provisions of the Convention on Biological Diversity, 1992 and International Treaty on Plant and Genetic Resources for Food and Agriculture, 2001, particularly the principles of prior informed consent as well as fair and equitable benefit sharing. 2. Each Party shall have the authority to determine access to genetic resources in accordance with its domestic legislation and endeavor to create conditions to facilitate transparent access to genetic resources. 5

21 ARTICLE IX MATERIAL TRANSFER AGREEMENT 1. Any activity under this MoU, which entails access to genetic resources, shall be carried out in accordance with domestic regulation of the providing country and with due respect of principle of benefit sharing and prior informed consent. 2. All research materials used in collaboration, when required by the respective laws, regulations and policies of the Parties, will be transferred using a Material Transfer Agreement (hereinafter referred to as MTA). 3. The terms and conditions of an MTA shall be dealt on case by case between the Parties. ARTICLE X PARTICIPATION OF THIRD PARTY Either Party may invite the participation of a third party in the joint projects and/or programs being carried out under this MoU upon obtaining the agreement of the other Party. In carrying out such joint projects and/or programs, the Parties shall ensure that the third party shall comply with the provisions of this MoU. ARTICLE XI SETTLEMENT OF DIFFERENCES All questions or differences that may arise in connection with the interpretation or application of this MoU shall be settled by means of consultation or negotiations between the Parties. ARTICLE XII INTELLECTUAL AND INDUSTRIAL PROPERTY 1. All intellectual and industrial property owned by one Party and used for the implementation of this MoU shall remain property of that Party. 6

22 2. All intellectual and industrial property that arisee- under the execution of this MoU, namely due to scientific discoveries or innovations, shall be equitably owned and shared between the Parties pursuant to a specific agreement on this matter. ARTICLE XIII AMENDMENTS The Parties may amend this MoU at any time by mutual agreement in writing. ARTICLE XIV ENTRY INTO FORCE, DURATION AND TERMINATION 1. This MoU shall enter into force on the date of its signing. 2. This MoU shall remain in force for a period of five (5) years, unless otherwise mutually extended by the Parties in writing at least six (6) months prior to its expiration. 3. This MoU may be terminated by both Parties at any time, and may be terminated by either Party upon three (3) months written notification to the other Party prior to the intended time of termination. 4. Unless. agreed otherwise, the termination of this MoU shall not affect the validity and duration of any ongoing arrangement, activity and contract made under this MoU until the completion of such arrangement, activity and contract. s. The termination of this MoU shall not release the Parties from the execution of the obligations resulting from the provisions of this MoU concerning security of information and settlement of differences. 6. This MoU shall substitute and supersede the Memorandum of Understanding between the Ministry of Agriculture of the Republic of Indonesia on Agricultural Cooperation and the Ministry of Agriculture and Fisheries of the Democratic Republic of Timor-Leste, signed in Jakarta, on the 29th of October of

23 IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments, have signed this MoU.
