Definitions Definições 1. TeleTrade : TeleTrade-DJ International Consulting Ltd, a limited liability Company registered as a Cyprus Investment Firm under registration number HE272810 and licensed by the Cyprus Securities and Exchange Commission under license number 158/11. 2. Client : A person who has entered into an agreement with TeleTrade, for investment and/or ancillary services which are authorized under TeleTrade s license number 158/11 issued by CySEC, in accordance with the Legal documentation forming the Operative Agreement between the client and TeleTrade found at http://teletrade.eu/trade/regulating_documents. 3. All terms contained herein shall bear the definition/ meaning given to them by the legal documentation forming the Operative Agreement between the client and TeleTrade found at http://teletrade.eu/trade/regulating_documents. 1. TeleTrade : TeleTrade-DJ International Consulting Ltd, uma companhia de responsabilidade limitada registada como uma Companhia de Investimentos Cipriota registada sob o número HE272810 e licenciada pela Cyprus Securities and Exchange Commission (Comissão de Mercados e Valores Mobiliários de Chipre) sob a Licença número 158/11. 2. Cliente : Uma pessoa que tenha celebrado um contracto com a TeleTrade para investimento e/ou serviços conexos para os quais a TeleTrade se encontra licenciada através da licença número 158/11 emitida pela CySEC, em conformidade com a documentação Legal que constitui o Contracto Operacional entre o cliente e a TeleTrade disponível na página do website http://teletrade.pt/trade/regulating_documents. 3. Todos os termos contidos neste documento devem ser entendidos com a exacta definição e/ou significado que lhes é dado pela documentação legal que constitui Contracto Operacional entre o cliente e a TeleTrade disponível na página do website http://teletrade.pt/trade/regulating_documents. Eligibility & Payment of Bonus Ilegibilidade e Pagamento do Bónus 4. To receive a Bonus a new client must open a trading account with TeleTrade and make a deposit in the trading account via the Client Login at the website: https://my.teletrade.eu/. 5. A Bonus may also be payable to all existing TeleTrade clients when they make a deposit of new funds, but is not payable on the client s existing funds, unless it is a 24% Promo Bonus which is being paid to the client for achieving a specified traded volume of lots per month. 6. All applications for new clients to open a trading account will be evaluated by the Compliance Department once the client has provided all the required documentation properly and fully completed, and only once he/she is approved will the client be eligible to receive the Bonus. 7. TeleTrade bonus schemes may vary from country to country so for exact details of applicable bonus schemes and promotions in your country please refer to your country s TeleTrade website. 4. Para receber um Bónus um novo cliente deve abrir uma conta de negociação com a TeleTrade e fazer um depósito na conta de negociação através da sua Área Pessoal no site: https://my.teletrade.eu/. 5. Aos clientes TeleTrade existentes poderá também ser pago um Bónus quando estes efectuarem um depósito de novos recursos, mas não é devido sobre os fundos existentes do cliente, excepto no caso do Bónus Promocional de 24% (''24% Promo Bónus'') o qual é pago aos clientes por alcançarem um determinado volume de lotes negociados por mês. 6. Todas as candidaturas de novos clientes para abertura de uma conta de negociação serão avaliadas pelo Departamento de Conformidade logo que o cliente tenha fornecido toda a documentação necessária correcta e totalmente preenchida e, uma vez aprovadas, o cliente torna-se elegível para receber o Bónus. 7. Os Sistemas de Bónus da TeleTrade pode variar de país para país, pelo que, para obter detalhes exactos de sistemas de Bónus e promoções que lhe são aplicáveis, por favor consulte o website TeleTrade do seu país. 2
Withdrawal & use of Bonus Levantamento e utilização dos Bónus 8. The Bonus may be used for trading without any restrictions, unless and in case any additional special conditions apply for specific types of Bonuses offered which can be found in the Client Login area at the website: https://my.teletrade.eu/ and/or at the website: http://teletrade.eu/. 9. Any profit earned by the client as a result of trading transactions involving the bonus may be withdrawn from the account without any restrictions, other than the condition that the below clause 13 has been fulfilled, or may be used for trading. 10. When the volume of the available funds (equity) on the trading account becomes less than the bonus amount TeleTrade has the right, without notification, to close open account positions, and also to cancel the bonus, if the requirements to the quantity of the closed lots have not been achieved. This is the general practice however may be excluded in some bonus offers/ promotions. For specific information please refer to applicable special conditions for such offers/ promotions 8. O Bónus pode ser utilizado para a negociação, sem quaisquer restrições, salvo se quaisquer condições adicionais especiais forem aplicáveis a determinados tipos de Bónus oferecidos, conforme seja indicado na Área Pessoal do cliente no website: https://my.teletrade.eu/e/ou no website: http://teletrade.pt/. 9. Qualquer lucro obtido pelo cliente como resultado de transacções comerciais que envolvam o Bónus pode ser retirado da conta, sem quaisquer restrições, para além do cumprimento da condição descrita na cláusula 13ª das presentes condições, ou pode ser utilizado para a negociação. 10. Quando o volume dos fundos disponíveis (capital próprio) na conta de negociação se tornarem menores do que o valor do bónus, a TeleTrade tem o direito, sem notificação, de fechar posições de contas abertas e também de cancelar o bónus, no caso de os requisitos para a quantidade de lotes fechados não sejam alcançados. Esta é a prática geral, porém pode ser excluída em algumas ofertas de bónus / promoções. Any Internal transfer of funds between the client s own accounts is not and will not be considered a deposit of new funds for the purposes of this Bonus offer and therefore the client will not be entitled to receive a Bonus under these circumstances. 12. Unless the provisions of clause 13 below have been fulfilled, if a withdrawal or internal transfer request is submitted to the trading account, the Bonus amount shall be cancelled and removed from the client s trading account. 13. In order to withdraw the Bonus amount a client must provide the required amount of traded lots after receiving the Bonus in the trading account within the specified time period, which will be stated in the specific Bonus offer which the client agrees to. The required amount of traded lots for each Bonus can be found in the Account History in the trading terminal MetaTrader and/or in the Client Login area at the website: https://my.teletrade.eu/ and/ or at the website: http://teletrade.eu/ 11. Qualquer Transferência Interna de fundos entre contas tituladas pelo cliente não são nem serão consideradas depósito de novos fundos para efeitos desta oferta de Bónus, não sendo o cliente elegível para o recebimento de Bónus sob estas circunstâncias. 12. Caso as provisões da cláusula 13ª das presentes condições não tenham sido preenchidas, se for submetido um pedido de levantamento ou de transferência interna de fundos para a conta de negociação, o montante do Bónus será cancelado e removido da conta de negociação do cliente. 13. Com vista ao levantamento do Bónus um cliente deverá fornecer a quantidade necessária de lotes transaccionados após receber o Bónus na conta de negociação, dentro do período de tempo especificado que será indicado na oferta do respectivo Bónus e com a qual o cliente está de acordo. A quantidade necessária de lotes transaccionados para cada Bónus pode ser encontrada no Histórico da Conta no terminal de negociação MetaTrader e/ou na Área Pessoal do cliente no website: https://my.teletrade.eu/ e/ou no site: http://teletrade.pt/. 3
14. If the required amount of traded lots is not achieved within the specified time period the Bonus will automatically expire and be removed from the Client s trading account. 15. Eligible financial instruments for trading to provide required amount of traded lots include only Forex and CFD on Metals. TeleTrade reserves the right to add or exclude other financial instruments at any moment at its own discretion. 16. The whole amount of required traded lots must always be achieved in order to withdraw the Bonus amount, which means there can be no partial completion/ redemption/ payment of the Bonus amount under any circumstances. 17. In the case of a 24% Promo Bonus payable for traded volume of lots then the above clause 13 shall not apply but instead the bonus shall be paid after the required amount of traded volume of lots per month is achieved. The required amount of monthly traded volume of lots can be found in the client s Personal Page at the website: https://my.teletrade.eu/ and/or at the website: http://teletrade.eu/. 18. The Bonus is not transferable. 14. Se a quantidade necessária de lotes transaccionados não for atingida dentro do período de tempo especificado, o Bónus expira automaticamente e será removido da conta de negociação do Cliente. 15. Os instrumentos financeiros elegíveis para negociação com vista ao fornecimento da quantidade necessária de lotes de negociação incluem somente Forex e CFD sobre Metais. A TeleTrade reserva-se o direito de adicionar ou excluir outros instrumentos financeiros, quando e como lhe aprouver. 16. Para que seja permitido o levantamento do montante do Bónus, o volume total requerido de lotes negociados terá sempre de ser atingido, o que significa que não pode haver realização, resgate ou pagamento parcial do valor do Bónus sob quaisquer circunstâncias. 17. No caso do Bónus Promocional de 24% ( 24% Promo Bónus ), pagável em função do volume de lotes transaccionados, não se aplica a disposição da cláusula 13ª das presentes condições, sendo o bónus pago após ter sido atingido o montante requerido do volume de lotes transaccionados por mês. O montante requerido para o volume mensal de lotes transaccionados pode ser encontrado na Área Pessoal do cliente no website: https://my.teletrade.eu/ e/ou no website http://teletrade.pt/. 18. O Bónus não é transferível. Reservations Reservas 19. TeleTrade reserves all rights to modify and/or alter and/or replace and/or cancel and/ or remove and/or discontinue and/or terminate this Bonus offer and each and any one or all of the present Terms & Conditions at any time and at its absolute discretion without prior notice. 20. TeleTrade reserves the right at its absolute discretion to withhold any Bonus in case any of the present Terms and Conditions have not been fulfilled by the client or where the client has attempted to abuse the Bonus or has acted fraudulently with a lack of good faith towards TeleTrade. 19. A TeleTrade reserva-se todos os direitos de modificar e/ou alterar e/ou substituir e/ou cancelar e/ou remover e/ou suspender e/ou cessar esta oferta Bónus e cada, qualquer um ou todos os presentes Termos e Condições, a qualquer momento e sob sua total e absoluta discricionariedade, sem aviso prévio. 20. A TeleTrade reserva-se o direito de, sob sua total e absoluta discricionariedade, retirar qualquer Bónus no caso de algum dos presentes Termos e Condições não terem sido cumpridos pelo cliente ou quando o cliente tenha tentado abusar do Bónus ou tenha agido de forma fraudulenta com má-fé para com a TeleTrade. 4
Acknowledgment/ Acceptance Reconhecimento/Aceitação 21. All of the present Bonus Terms and Conditions are essential and binding and by depositing funds in the trading account under this offer the client acknowledges that he/she has read, understood and unconditionally accepted and agreed to be bound by the present Bonus Terms and Conditions and/or any additional special conditions relating to a specific Bonus as the case may be, to be found on the TeleTrade website at http://teletrade.eu/. 21. Todos os presentes Termos e Condições de Bónus são essenciais e vinculativos e, ao depositar fundos na conta de negociação sob essa oferta, o cliente reconhece que leu, compreendeu, aceita incondicionalmente e concorda em ficar vinculado por estes Termos e Condições de Bónus e/ou quaisquer condições especiais adicionais relativas a um Bónus específico, conforme o caso, que podem ser encontradas no website da TeleTrade em http://teletrade.pt/. Jurisdiction Jurisdição 22. All present Bonus Terms and Conditions are governed by the Laws of the Republic of Cyprus and in case of a dispute which cannot be resolved by mutual agreement are subject to the exclusive jurisdiction of the District Courts of the Republic of Cyprus. 22. Todos os presentes Termos e Condições de Bónus são regidos pelas leis da República de Chipre, e em caso de uma disputa que não possa ser resolvida por mútuo acordo estão sujeitos à jurisdição exclusiva dos Tribunais Distritais da República de Chipre. 5
