GOLDEN VISA The ARI - special arrangement for granting and renewal of residence permit, with exemption of a residence visa, for investment activity in the country - has undergone considerable changes that entered into force on January 29, 2013. Changes to the minimum requirements for assigning residence permit motivated by the designated "Investment business activity". - Order in 1661-A/2013 - Amends Order No. 11820-A/2012 of September 4, 2012, which defines the conditions for the application of the special arrangements for residence permits for investment activity in the country. The main changes relate to the definition and characteristics of possible investments: The acquisition of real estate property shall comprise the acquisition: 1 ) In joint ownership, since each joint owner invests equal to or exceeding 500 thousand euros; 2 ) Through preliminary contract of purchase and sale, with sign equal to or exceeding 500 thousand euros; The investment through purchase of real estate also comprises the possibility to charge them from a value greater than 500 thousand euros; As well as the possibility of giving lease and exploration for commercial, agricultural or tourism purposes. How does the ARI work And which allows this new regime: This new law allows you the investor and your family to live in Portugal and move around the 27 Schengen countries through a residence permit in Portugal. Who can apply? National citizens of any third States, meaning by third States, the States not members of the European Union, nor belonging to the Schengen areawhich conduct an investment activity, either personally or through a corporation in the national territory and for a minimum period of five years. Absence of conviction for a crime that is punishable in Portugal by deprivation of liberty for more than one year; It is in the period of prohibition of entry into national territory, following a removal of the Country; Absence of alert in the Schengen Information System; No indication on Integrated Information System for the purposes of non-sef admission. Minimum time requirement Five years for the maintenance of investment activities, which count starts from the date of granting the residence permit.
Family regrouping The holder of a Residence Permit for Investment Activity may request family reunification, which is applicable to spouse, minor or disabled dependents of the couple or one of the spouses; children adopted; adult children, dependent on the couple or one spouse who are unmarried and are studying in a school in Portugal; upward in a straight line and 1. degree of the resident or his spouse, who are dependents; younger siblings, provided they are supervised by the resident, in accordance with decision of the competent authority of the country of origin, provided that this decision is recognized by Portugal. Periods of time in Portugal For the renewal of residence permit, applicants must demonstrate citizens have fulfilled the minimum periods of stay in national territory of 7 days, consecutive or otherwise, in the 1st. year, and 14 days in the third year consecutive or in subsequent periods two years. Ability to travel through the Schengen territory The investor may move freely within the Schengen area during the 7 or 14 days. Renewals Renewals will be processed at the end of the first year and at the end of the third and at the end of the fifth year, by checking the maintenance of the requirements. Portuguese nationality At the end of 5 years you can apply for naturalization, provided that are met the necessary requirements.

Quem pode requerer? Os cidadãos nacionais de Estados terceiros, entendendo-se por Estados Terceiros, os Estados não membro da União Europeia, nem pertencentes ao espaço Schengen, que exerçam uma actividade de investimento, pessoalmente ou através de uma sociedade, em território nacional e por um período mínimo de cinco anos. No caso de aquisição de bens imóveis de valor igual ou superior a 500 mil euros - demonstre ter a propriedade de bens imóveis podendo: a) Adquiri-los em regime de compropriedade, desde que cada comproprietário invista valor igual ou superior a 500 mil euros, ou através de contrato -promessa de compra e venda, com sinal igual ou superior a 500 mil euros, devendo apresentar antes do pedido de renovação de ARI o respectivo título de aquisição; b) Onerá-los a partir de um valor superior a 500 mil euros; c) Dar de arrendamento e exploração para fins comerciais, agrícolas ou turísticos. Título aquisitivo ou de promessa de compra dos imóveis de onde conste declaração de uma instituição financeira autorizada ao exercício da sua actividade em território nacional atestando a transferência efectiva de capitais para a sua aquisição ou para efectivação de sinal de promessa de compra no valor igual ou superior a 500 mil euros; e Certidão actualizada da conservatória do registo predial, da qual deve sempre constar, no caso de contrato -promessa e sempre que legalmente viável, o respectivo registo. Prova da situação contributiva regularizada mediante apresentação de declaração negativa de dívida actualizada emitida pela Autoridade Tributária e Aduaneira e pela Segurança Social. Ausência de condenação por crime que em Portugal seja punível com pena privativa de liberdade de duração superior a um ano; Não se encontrar no período de interdição de entrada em território nacional, subsequente a uma medida de afastamento do País; Ausência de indicação no Sistema de Informação Schengen; Ausência de indicação no Sistema Integrado de Informações do SEF para efeitos de não admissão. Requisito temporal mínimo Cinco anos para a manutenção das actividades de investimento, cuja contagem se inicia a partir da data da concessão da autorização de residência.
Reagrupamento familiar O titular de Autorização de Residência para Actividade de Investimento pode solicitar Reagrupamento Familiar, que é aplicável a cônjuge; filhos menores ou incapazes a cargo do casal ou de um dos cônjuges; menores adoptados; filhos maiores, a cargo do casal ou de um dos cônjuges, que sejam solteiros e se encontrem a estudar num estabelecimento de ensino em Portugal; ascendentes na linha recta e em 1º. grau do residente ou do seu cônjuge, desde que se encontrem a seu cargo; irmãos menores, desde que se encontrem sob tutela do residente, de harmonia com decisão proferida pela autoridade competente do país de origem e desde que essa decisão seja reconhecida por Portugal. Períodos de tempo em Portugal Para efeitos de renovação de autorização de residência, os cidadãos requerentes devem demonstrar ter cumprido os prazos mínimos de permanência em território nacional de 7 dias, seguidos ou interpolados, no 1.º ano, e 14 dias, seguidos ou interpolados, nos subsequentes períodos de dois anos. Possibilidade de viajar pelo Espaço Schengen O investidor poderá circular livremente no Espaço Schengen durante os 7 ou 14 dias. Renovações As renovações processam-se no final do primeiro ano e no final do terceiro e no final do quinto ano, por verificação da manutenção dos requisitos exigidos. Nacionalidade portuguesa Ao final de 5 anos poderá requerer a naturalização, desde que cumpridos os requisitos necessários.
