Implementation of Directive 2008/0/EC, 9th of November Directive published on Official Journal of the EU on 3.0.2009; Entry into force on 02.02.2009; The Member-States (MS) have to transpose it until 02 nd of February 200.
Implementation of Directive 2008/0/EC, 9th of November Directive s Implementation: The aim of European Commission (EC) was to publish the list with the pair Operator Member-State until 0.02.2009 (Art. 8a(3)(a)); Every year the list will be updated by the EC until 0 st February; Until 02.08.2009 EC takes a decision about the aviation historic emissions (Art. 3.º-C(4)); The Directive foresees that several issues of the legislation shall be approved by the Committee.

Current negotiation process: Committee and Working groups Technical working group of Aviation in ETS (APA/INAC) There were 0 meetings since October 2008; The group prepared: Monitoring Decision, templates to submit emissions Monitoring Plan and t-km Monitoring Plan, as well as templates to report the annual emissions and t-km data; This group will meet periodically to discuss the matters related to the Directive s implementation of Aviation s integration in ETS.
Current negotiation process: Committee and Working groups ETS Compliance Forum Additional mechanism created by the EC and MS to help in the harmonized development of ETS, it was approved in January by the Climate Change Committee, to whom reports; It occurred 5 meetings which in APA participated; The involvement of the MS is voluntarily.
Current negotiation process: Committee and Working groups ETS Compliance Forum So far were produced the following documents: Q&A Report on EU ETS Aviation; Aviation guidance; Examples of Monitoring Plans for annual emissions and for t-km.
Current negotiation process: Committee and Working groups ETS Compliance Forum Prevêem-se as seguintes tarefas: Harmonized validation of Monitoring Plans; Enforcement & Sanctions; Preparing for validating t-km & annual emissions reports; E-reporting and the use of IT in ETS.
Current negotiation process: Committee and Working groups ETS Compliance Forum There will be a Conference of Compliance on the 3 rd and 4 th of September, the debate will focus on the mentioned subjects and others related to ETS in general, always with the aim of harmonizing procedures among the MS in the implementation of ETS.
Current negotiation process: Committee and Working groups Other important meetings - Meetings of stakeholders, organized by the EC and also Eurocontrol, with the participation of the MS; - DGTren in cooperation with DGEnv, both directories of EC, promoted a meeting among the MS to discuss the matters related with the verification of the compliance with ETS by the aircraft operators (AO) from outside EU.
Current negotiation process: Committee and Working groups Documents approved by comitology: - Commission Decision 2009/339/CE, of 6 April 2009 - amending Decision 2007/589/CE as regards the inclusion of monitoring and reporting guidelines for emissions and t-km data from Aviation activities; - Guidelines on the detailed interpretation of aviation activities listed in Annex I of Directive 2008/0/CE - the purpose of these guidelines is to clarify about the aviation activities included in and those excluded from ETS.

Tasks in progress List of pair Operator - MS - public consultation until 3.03.2009; - PT sent the comments on time, the main notes were: 70 of 0 aircraft operators (AO) were identified as being in the INAC s database with registered movements in national airports/ aerodromes, 3 AO don t have records of movements in PT and AO are missing in the list; - in total were received around 80 comments from MS and stakeholders, that may imply the change of ±500 AO from administering MS; - It s predicted that the final list will be published on the beginning of July.
Tasks in progress Calculation of historic aviation emissions to establishes the ETS CAP - the data used is from 2004 to 2006; - in the end of April, we received documents with the methodology of calculation of historic emissions, made by Eurocontrol and checked by Universidad Politécnica de Madrid and by INNAXIS Research Institute; - this methodology was also checked by the following institutions: Air & Climate Change unit of the European Environment Agency, Transport & Air Quality unit of the Joint Research Centre e Environmental Protection unit of the European Aviation Safety Agency;
Tasks in progress Calculation of historic aviation emissions to establishes the ETS CAP - the deadline to comment was short, by the beggining of May; - 5 MS sent comments, among those was PT; - the objective is to present the calculation of historic aviation emissions to the Climate Change Committee on 7.06.09; - foresees that the adoption and publication of these data take place in July.
Calendar of aviation integration in ETS CO 2 annual emissions and t-km data - CE publishes the final list of pair operator-ms: beginning of July; - The Aircraft Operator (AO) submits to the Competent Authority (CA) the annual emissions monitoring plan and the t-km (t-km is a voluntary procedure, only applicable if AO wants to benefit from free allowances) until: 3.08.2009; - The CA approves the annual emissions and t-km monitoring plans until: 3.2.2009;
Calendar of aviation integration in ETS CO 2 annual emissions and t-km data - The AO begins to monitor and record annual emissions and t- km data (if applicable): 0.0.200; - The AO hires an independent entity to verify its t-km report of 200, which after shall be submited to the CA to require for free allowances until: 3.03.20; - The AO hires an independent entity to verify its annual emissions report of 200, which after shall be submited to the CA to require for free allowances until: 3.03.20;
Calendar of aviation integration in ETS CO 2 annual emissions and t-km data - EC publishes the total number of allowances and benchmark until: 30.09.20; - The AO submits to the CA an updated Monitoring Plan until: 3.08.20; - The CA transfers the free allowances to each operator s account of the Register until: 28.02.202; - The AO hires an independent entity to verify its annual emissions report of 20, which after shall be submited to the CA to require for free allowances until: 3.03.202;
Calendar of aviation integration in ETS CO 2 annual emissions and t-km data - The AO hires an independent entity to verify its annual emissions report of 202, which after shall be submited to the CA to require for free allowances until: 3.03.203; - The AO has to surrender allowances to the CA, the amount corresponds to its CO 2 annual emissions of 202, until: 30.04.203.
Legislation foresees Penalties Art.º 6 Directive 2008/0/CE; Enables fines and operating bans to be used; Paragraph 2 provides that detailed rules shall be established in the scope of comitology.
Next Steps Amendment to the Registries Regulation so to include the sector of Aviation; Regulation on Auctioning; Decision on cap and benchmark for free allocation; Rules for functioning of special reserve.
