1 REPUBLIK INDONESIA MEMORANDUM SALING PENGERTIAN ANTARA KEMENTERIAN PENDIDIKAN DAN KEBUDAYAAN REPUBLIK INDONESIA DAN KEMENTERIAN PENDIDIKAN REPUBLIK DEMOKRATIK TIMOR-LESTE TENTANG KERJA SAMA BIDANG PENDIDIKAN Kementerian Pendidikan dan Kebudayaan Republik Indonesia dan Kementerian Pendidikan Republik Demokratik Timor-Leste, untt..il< selanjutnya disebut sebagai "Para Pihak"; ;. MEMPERTIMBANGKAN kepentingan bersama dalam mendorong kerja sama bidang pendidikan; BERKEINGINAN untuk meningkatkan kerja sama bidang pendidikan; MERUJUK pada Perjanjian antara Pemerintah Republik Indonesia dan Pemerintah Republik Demokratik Timor-Leste tentang kerja sama Pendidikan dan Kebudayaan, tanggal 8 Juli 2005; SESUAI dengan hukum dan peraturan perundang-undangan yang berlaku di masing-masing negara serta prosedur dan kebijakan tentang kerja sama pendidikan; TELAH MENCAPAI KESEPAHAMAN sebagai berikut:

2 PASALI TUJUAN Tujuan Memorandum Saling Pengertian (MSP) ini adalah untuk meningkatkan kerja sama pendidikan berdasarkan kesetaraan, resiprositas dan saling menguntungkan, serta memajukan hubungan dan saling pengertian antara Para Pihak. PASAL II Ruang Lingkup Kerja Sama Para Pihak akan mendorong dan memfasilitasi kerja sama dalam ruang lingkup sebagai berikut: 1. Pertukaran informasi dan publikasi ilmiah tentang pendidikan anak usia dini, pendidikan dasar, menengah, umum, kejuruan dan teknik, dan pendidikan tinggi yang diselenggarakan melalui jalur pendidikan formal, non-formal, dan in-formal; 2. Program pertukaran untuk guru, tenaga ahli, dosen, dan pelajar; 3. Peningkatan sekolah dan universitas/politeknik melalui usaha-usaha bersama menyangkut school system, program bersama dan kegiatan pelajar bersama; 4. Pengakuan bersama untuk gelar yang diberikan oleh lembaga pendidikan Indonesia dan Timor-Leste, sesuai dengan hukum dan peraturan dari Para Pihak; 5. Pengembangan professional bagi guru, kepala sekolah, dan dosen; 6. Memberikan beasiswa kepada mahasiswa dari Para Pihak, berdasarkan ketersediaannya; 7. Penelitian bersama dan publikasi internasional; 8. Mempromosikan bahasa pengajaran Para Pihak; 9. Memfasilitasi program magang untuk pendidikan kejuruan dan teknik pada tingkat menengah dan tinggi; 10. Bidang lain yang disepakati bersama oleh Para Pihak.

3 PASAL Ill Pengaturan Teknis dan Keuangan 1. Kerja sama di bawah MSP ini dilaksanakan dengan membuat pengaturan khusus. 2. Pengaturan tersebut menjelaskan perihal keuangan, rincian program, proyek, jadwal, tanggung jawab Para Pihak dan hal-hal terkait lainnya. 3. Pelaksanaan kegiatan di bawah MSP ini wajib disesuaikan dengan ketersediaan dana dan personil dari Para Pihak. 4. Jika dipandang perlu, Para Pihak dapat mengundang pihak ketiga untuk terlibat dalam pelaksanaan MSP ini. Kerja sama tersebut harus disepakati oleh kedua belah pihak dan diatur dalam pengaturan terpisah. PASAL IV Kelompok Kerja Bersama 1. Para Pihak sepakat untuk membentuk kelompok kerja bersama untuk memfasilitasi, memantau, dan meninjau pelaksanaan MSP ini secara teratur. 2. Kelompok Kerja Bersama akan diketuai bersama oleh perwakilan Kementerian Pendidikan dan Kebudayaan Republik Indonesia dan perwakilan Kementerian Pendidikan Republik Demokratik Timor-Leste, dengan keikutsertaan lembaga lain yang sesuai, dan akan bertemu setidaknya sekali dalam setahun, baik di Indonesia maupun di Timor-Leste. 3. Dalam kondisi tertentu dimana pertemuan tidak dapat dilaksanakan, pertukaran dokumen akan dilakukan sebagai pengganti pertemuan terse but.

4 PASAL V Perlindungan Hak Kekayaan lntelektual 1. Setiap Pihak wajib melindungi, dalam wilayahnya, hak kekayaan intelektual dari Pihak lainnya sesuai dengan hukum nasional yang berlaku di negara masing-masing. 2. Dalam hal pengaturan spesifik, program atau hasil proyek hak kekayaan intelektual, hak kekayaan tersebut harus dimiliki bersama, dan Para Pihak akan membuat pengaturan terpisah sesuai dengan hukum dan peraturan masing-masing negara untuk perlindungan hak-hak tersebut. PASAL VI Kerahasiaan 1. Para Pihak wajib menjaga kerahasiaan dokumen, informasi, dan data-data lainnya yang diterima atau diberikan oleh Pihak lainnya untuk pelaksanaan MSP ini atau perjanjian lainnya yang dibuat berdasarkan MSP ini. 2. Para Pihak sepakat bahwa ketentuan dalam Pasal ini akan terus mengikat kedua belah Pihak meskipun MSP ini berakhir. PASAL VII Pembatasan Kegiatan Personil Setiap Pihak harus menjamin bahwa personilnya yang terlibat dalam kegiatankegiatan di bawah MSP ini harus menghormati integritas wilayah dan kemerdekaan politik negara yang menjadi tuan rumah, berkewajiban untuk tidak mencampuri urusan dalam negeri negara tersebut dan tidak melakukan kegiatan - kegiatan yang tidak sesuai dengan maksud dan tujuan dari MSP ini.

5 PASAL VIII Penyelesaian Sengketa Setiap sengketa yang timbul dari penafsiran dan/atau pelaksanaan dari MSP ini wajib diselesaikan secara damai melalui konsultasi atau negosiasi diantara Para Pihak. PASAL IX Penangguhan Setiap Pihak memiliki hak, untuk alasan keamanan, ketertiban umum atau kesehatan masyarakat, untuk menangguhkan sementara waktu, baik secara keseluruhan ataupun sebagian, pelaksanaan MSP ini dengan memberikan pemberitahuan secara tertulis melalui saluran diplomatik. PASAL X Amandemen MSP ini dapat ditinjau ulang dan diubah setiap saat, dengan kesepakatan tertulis dari Para Pihak. Perubahan tersebut mulai berlaku pada tangga~ yang ditetapkan oleh Para Pihak dan wajib menjadi bagian yang tidak terpisahkan dari MSP ini.

6 PASAL XI Mulai Berlaku, Masa Berlaku, dan Pengakhiran 1. MSP ini mulai berlaku pada tanggal penerimaan pemberitahuan tertulis terakhir dari satu Pihak ke Pihak lainnya melalui saluran diplomatik yang menyampaikan telah selesainya prosedur internal. 2. MSP ini berlaku untuk jangka waktu 5 (lima) tahun dan dapat diperpanjang untuk jangka waktu yang sama dengan persetujuan tertulis dari Para Pihak melalui saluran diplomatik. 3. Salah satu Pihak dapat mengakhiri MSP ini setiap saat dengan memberikan pemberitahuan tertulis kepada Pihak lainnya mengenai keinginannya untuk mengakhiri MSP ini setidaknya 6 (enam) bulan sebelum tanggal pengakhiran yang dikehendaki. 4. Pengakhiran MSP tidak akan mempengaruhi keabsahan dan masa berlaku setiap pengaturan, program, kegiatan atau proyek yang dibuat berdasarkan MSP ini sampai selesainya pengaturan, program, kegiatan atau proyek tersebut, kecuali Para Pihak memutuskan sebaliknya.

7 SEBAGAI BUKTI, yang bertandatangan dibawah ini, dengan diberi kuasa oleh Pemerintahnya masing-masing, telah menandatangani Memorandum Saling Pengertian ini. DIBUAT dalam rangkap dua di Dili pada tanggal 26 Agustus 2014, dalam bahasa Indonesia, bahasa Portugis dan bahasa lnggris, seluruh naskah memiliki kekuatan hukum yang sama. Apabila terdapat perbedaan penafsiran terhadap Memorandum Saling Pengertian ini, maka naskah dalam Bahasa lnggris yang berlaku. 8 ~~ \ ;;B~ REPUBLIK ~ INDONESIA MEMORANDO DE ENTENDIMENTO ENTRE 0 MINISTERIO DA EDUCACAO E DA CUL TURA DA REPUBLICA DA INDONESIA E 0 MINISTERIO DA EDUCACAO DA REPUBLICA DEMOCRATICA DE TIMOR-LESTE SOBRE A COOPERACAO NO DOMiNIC DA EDUCACAO o Ministerio da Educa<;ao e Cultura da Republica da Indonesia e 0 Ministerio da Educa<;ao da Republica DemocrcHica de Timor-Leste, doravante designados "Partes"; COSIDERANDO o interesse mutuo na promo<;ao da coopera<;ao no dominic da educa<;ao; DESEJANDOampliar e intensificar a coopera<;ao no campo da educa<;ao, da ciemcia e tecnologia; CONSIDERANDOo acordo entre o Governo da Republica da Indonesia e o Governo da Republica Democratica de Timor-Leste sobre a Coopera<;ao Cultural e Educacional, de 8 de Julho de 2005; EM CONFORMIDADE com a legisla<;ao e regulamentos vigentes, bern como comes procedimentos ; e politicas relativas a coopera<;ao educacional des respetivos paises; Chegaram ao seguinte entendimento:

9 ARTIGO I Objetivo 0 presente Memoranda de Entendimento (MdE) tern como objetivo o desenvolvimento da cooperac;ao educacional, cientifica e tecnol6gica numa base de igualdade, reciprocidade e beneficia mutuo, e a promoc;ao de relac;oes de entendimento entre ambas as Partes. ARTIGO II Ambito da Coopera~ao As partes devem incentivar e facilitar a cooperac;ao nas seguintes areas: 1. Troca de informac;ao e publicac;oes cientificas sobre educac;ao pre-escolar, ensino primario, secundario, tecnico-vocacional e superior, fornecidas atraves de educac;ao formal, nao-formal e informal; 2. Troca de programas para professores, peritos, membros do corpo docente e estudantes; 3. Melhoria do ensino escolar, politecnico e universitario atraves de esfon;os concertados respeitantes ao sistema escolar, programas conj~ntos e atividades estudantis conjuntas; 4. Reconhecimento mutuo de graus academicos concedidos por instituic;oes de ensino da Indonesia e de Timor-Leste, de acordo com as leis e regulamentos das Partes; 5. Desenvolvimento profissional de professores, diretores de escola e membros do corpo docente; 6. Conceder bolsas a estudantes das Partes, de acordo com os meios disponiveis; 7. Efetuar pesquisa conjunta e publicac;oes internacionais; 8. Promover a lingua de ensino das Partes; 9. Facilitar programas de estagio para educac;ao tecnico-vocacional ao nivel secundario e terciario; 10. Outras areas mutuamente acordadas pelas Partes.

10 ARTIGO Ill Programas tecnicos e financeiros 1. A cooperac;ao ao abrigo do presente MdE deve ser implementada atraves da celebrac;ao de programas especificos. 2. Os programas acima referidos especificam os assuntos financeiros, programas detalhados, projetos, calendarizac;ao, responsabilidades das Partes e outros assuntos relacionados. 3. A implementac;ao de atividades ao abrigo do presente MdE esta sujeita a disponibilidade de fundos e recursos humanos das Partes. ARTIGO IV Grupo de Trabalho Conjunto 1. As Partes acordam no estabelecimento de um grupo de trabalho conjunto para facilitar, monitorizar e rever a implementac;ao do presente MdE numa base regular Grupo de Trabalho conjunto deve ser co-presidido por representantes do Ministerio da Educac;ao da Republica Democratica de Timor-Leste e doministerio da Educac;ao da Republica da Indonesia e com a participac;ao de outras agencias apropriadas, devendo reunir-se, pelo menos, uma vez por ano, na Indonesia ou em Timor-Leste. 3. Em certas circunstancias, quando o encontro nao puder realizar-se, devem ser trocados documentos em Iugar do referido encontro.

11 ARTIGOV Prote~ao dos Direitos de Propriedade lntelectual 1. Cada Parte deve proteger quaisquer direitos resultantes de propriedade intelectual usados pela outra Parte para a implementac;ao do MdE de acordo com as respetivas leis, regulamentos e acordos internacionais nos quais a Republica Democratica de Timor-Leste e a Republica da Indonesia sejam Partes; 2. A protec;ao de quaisquer direitos de propriedade intelectual resultantes da implementac;ao deste MdE deve ser estipulada em acordo(s) especifico(s) a ser(em) concluido(s) entre as Partes. ARTIGOVI Confidencialidade 1. As Partes devem comprometer-se a observar confidencialidade e segredo em relac;ao a documentos, informac;oes e outros dados recebidos ou fornecidos pelas Partes para implementac;ao deste MdE ou nos termos do mesmo. 2. As Partes acordam que a previsao deste artigo deve continuar a ser obrigat6ria para um periodo a acordar entre as ambas, nao obstante a cessac;ao deste MdE. ARTIGO VII Limita~ao do Pessoal As Partes devem assegurar-se que o seu pessoal envolvido em atividades ao abrigo deste MdE deve participar apenas em atividades sob o quadro do MdE, com respeito das leis nacionais e regulamentos dos respetivos paises.

12 ARTIGO VIII Resolu~ao de litigios Qualquer controversia relativa a interpretac;ao e/ou implementac;ao deste MdE deve ser resolvida amigavelmente atraves de negociac;ao ou consulta entre as Partes. ARTIGO IX Suspensao Cada Parte reserva-se ao direito de suspender, no todo ou em parte, a implementac;ao do presente MdE, por razoes de Seguranc;a, Ordem Publica ou Saude Publica, atraves de notificac;ao escrita a outra Parte atraves de canais diplomaticos. ARTIGOX Aditamentos 0 presente MdE pode ser revisto e aditado a todo o tempo, por escrito, por mutuo consentimento das Partes. 0 referido aditamento deve entrar em vigor nessa mesma data ou noutra determinada pelas Partes e deve constituir parte integrante do presente MdE. ARTIGOXI Entrada em Vigor, Dura~ao e Termo 1. 0 presente Memoranda de Entendimento entra em vigor na data da recepc;ao da ultima notificac;ao,por escrito e por canais diplomaticos, de uma Parte para outra Parte, ap6s a conclusao dos respectivos procedimentos internos.

13 2. Este MdE deve permanecer em vigor durante o perfodo de 5 (cinco) anos e pede ser prorrogado per igual perfodo, per mutuo consentimento das Partes, per escrito e per canais diplomaticos. 3. Qualquer das Partes pede cessar o presente MdE, a todo tempo, atraves de notifica<;ao escrita a outra Parte da sua inten<;ao de o fazer, com o mfnimo de 6 meses de antecedemcia. 4. A cessa<;ao do presente MdE nao afeta a validade e dura<;ao de quaisquer entendimentos, programas, atividades ou projetos ao abrigo do presente MdE ate a respetiva finaliza<;ao des mesmos, a nao ser que as Partes decidam noutro sentido. TESTEMUNHAM, os abaixo-assinados, devidamente autorizados para o efeito pelos seus respectivos governos, a assinatura deste Memoranda de Entendimento. FEITOem Dfli,aos26 de Agosto de 2014, em duplicado, nas lfnguas portuguesa, indonesia, e inglesa. Todas as versoes sao igualmenteautenticas. No case de alguma divergencia de interpreta<;ao deste Memoranda de Entendimento, deve prevalecer a versao inglesa. REPUBLIK INDONESIA MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF EDUCATION AND CULTURE OF THE REPUBLIC OF INDONESIA AND THE MINISTRY OF EDUCATION OF THE DEMOCRATIC REPUBLIC OF TIMOR-LESTE ON COOPERATION IN THE FIELD OF EDUCATION The Ministry of Education and Culture of the Republic of Indonesia and the Ministry of Education of the Democratic Republic of Timor-Leste hereinafter referred to as "the Parties"; CONSIDERING their mutual interest in promoting cooperation in the -area of education; DESIRING to expand and to intensify cooperation in the field of education; REFERRING to the Agreement between the Government of the Republic of Indonesia and the Government of the Democratic Republic of Timor-Leste on Cultural and Educational Cooperation on 8 July 2005; PURSUANT to the prevailing laws and regulations, as well as the procedures and policies concerning educational cooperation in their respective countries; HAVE REACHED AN UNDERSTANDING as follows:

15 ARTICLE I Objective The objective of this Memorandum of Understanding (MoU) is to develop educational cooperation on the basis of equality, reciprocity and mutual benefit, and to promote relations and mutual understanding between the Parties. ARTICLE II Scope of Cooperation The Parties shall encourage and facilitate cooperation on the following areas: 1. Exchange of information and scientific publication on early childhood education, primary, secondary, general, vocational and technical, and higher education provided through formal, non-formal, and in-formal education; 2. Exchange programs for teachers, experts, faculty members, and students; 3. Improvement of school and university/polytechnic through joint efforts related to school-system, joint programs and joint student activities; 4. Mutual recognition of degrees awarded by Indonesian and Timor.. Leste educational institutions, pursuant to the laws and regulations of the Parties; 5. Professional development of teachers, school principals, and faculty members; 6. Provide scholarships to students of the Parties, on the availability of the means; 7. Joint research and international publications; 8. Promote the teaching language of the Parties; 9. Facilitate internship program for vocational and technical education at secondary and tertiary levels; 10. Other areas as mutually agreed upon by the Parties.

16 ARTICLE Ill Technical and Financial Arrangements 1. The cooperation under this MoU shall be implemented through conclusion of specific arrangements. 2. Such arrangements specify financial matters, detailed programs, projects, schedules, responsibilities of the Parties and other related matters. 3. The implementations of the activities under this MoU are subject to the availability of fund and personnel of the Parties. 4. If deemed necessary, the Parties may invite a third party to involve in the implementation of this MoU. Such cooperation shall be agreed by both Parties and regulated in separate arrangement. ARTICLE IV Joint Working Group 1. The Parties agreed to establish a joint working group to facilitate, monitor, and review the implementation of this MoU on a regular basis. 2. The Joint Working Group shall be co-chaired by a representative of the Ministry of Education and Culture of the Republic of Indonesia and a representative of Ministry of Education of the Democratic Republic of Timor Leste with participation of other agencies as appropriate, and shall meet at least once a year, either in Indonesia or Timor-Leste. 3. In a certain circumstance where the meeting could not be held, documents shall be exchanged in lieu of such a meeting. ARTICLE V Protection of Intellectual Property Rights 1. Each Party shall protect, within its territory, intellectual property rights of the other Party in accordance with the domestic law in force in their respective countries.

17 2. In case of specific arrangement, programs or project result in intellectual property rights, such property rights shall be jointly owned, and the Parties shall conclude separate arrangement in accordance with the laws and regulations of the respective countries for the protection of such rights. ARTICLE VI Confidentiality 1. The Parties shall undertake to observe the confidentiality and secrecy of documents, information, and other data received or supplied by the Parties for the implementation of this MoU or any other agreement made pursuant to this MoU. 2. The Parties agree that the provision of this Article shall continue to be binding for a period to be agreed upon between the Parties notwithstanding the termination of this MoU. ARTICLE VII Limitation of Personnel Each Parties shall ensure that its personnel involved in the activities under this MoU shall respect territorial integrity and political independence of the host country, shall have a duty not to interfere with the domestic affairs of the said country neither to conduct the activities inconsistent with the purpose and objective of this MoU. ARTICLE VIII Settlement of Dispute Any dispute arises from the interpretation and/or implementation of this MoU shall be settled amicably through negotiation or consultation between the Parties.

18 ARTICLE IX Suspension Each Party reserves the right, for reasons of security, public order or public health, to suspend temporarily, either in whole or in part, the implementation of this MoU by giving written notification through diplomatic channels. ARTICLE X Amendment This MoU may be reviewed and amended at any time, by mutual written consent of the Parties. Such amendment shall come into effect on such date as may be determined by the Parties and shall form an integral part of this MoU. ARTICLE XI Entry Into Force, Duration And Termination 1. This MoU shall enter into force on the date of the receipt of the last written notification from one Party to another Party through diplomatic chqnnels informing the completion of its internal procedures. 2. This MoU shall remain in force for a period of 5 (five) years and may be extended for one period by mutual written consent of the Parties through diplomatic channel. 3. Either Party may terminate this MoU at any time by giving written notification to the other Party of its intention to terminate this MoU at least 6 (six) months in advance of the intended date of termination. 4. The termination of this MoU shall not affect the validity and duration of any arrangements, programs, activities or projects made under this MoU until

19 the completion of such arrangements, programs, activities or projects unless the Parties decided otherwise. ~. IN WITNESS WHEREOF, the undersigned, being duly authorized thereto by their respective Governments have signed this Memorandum of Understanding. DONE in duplicate at Dili on 26 1 h of August 2014, in Indonesian, Portugese, and English languages, all texts being equally authentic. In case of any divergence of interpretation of this Memorandum of Understanding, the English text shall prevail.
