INTRODUÇÃO: Em 2004 o Ministério Público Holandês acusa dois neonatologistas de crime de eutanásia. Em 2005 são divulgados dois artigos na literatura científica. "The Groningen Protocol: Euthanasia in Severely Ill Newborns," New England Journal of Medicine 352 (2005): 959-62; E. Verhagen and P.J.J. Sauer "End-of-Life Decisions in Newborns: An Approach from the Netherlands," Pediatrics 116 (2005): 736-39. O Protocolo foi criado pela colaboração do Ministério Público e de um comité médico da University Medical Center de Groningen. O Protocolo está ratificado pela National Associaton of Pediatricians.
-O CONTEXTO E O ÂMBITO DE APLICAÇÃO DO PROTOCOLO: -Contexto: (1) - Os Artigos 293 e 294 do Código Penal Holandês criminalizam a Eutanásia e o Suicídio Medicamente Assistido. -O Termination of Life on Request and Assisted Suicide Act de 1 de Abril 2002, permite a Eutanásia e o a maiores de 16 anos, quando preenchidos alguns requisitos. - O Duo Care / Dever de Assistência.
-O CONTEXTO E O ÂMBITO DE APLICAÇÃO DO PROTOCOLO: Contexto: (2) As condições/requisitos a preencher: 1) Pedido voluntário e consistentemente formulado. 2) Presença de um sofrimento insuportável, sem perspectiva de vida. 3) Consentimento informado. 4) Ausência de alternativa razoável 5) Pelo menos uma opinião independente. 6) Uma escolha apropriada para a aplicação da eutánasia medicamente assistida.

- O CONTEXTO E O ÂMBITO DA APLICAÇÃO DO PROTOCOLO: ÂMBITO DE APLICAÇÃO: 1 RNs sem possibilidade de sobrevivência. 2 - RNs que podem sobreviver após um período de tratamento intensivo, mas as expectativas em relação à sua condição de vida futura são muito sombrias. 3 - RNs com um prognóstico extremamente pobre, que não dependem da tecnologia para a estabilidade fisiológica mas cujo sofrimento é: grave, sustentado, e não pode ser aliviado. O Protocolo de Groningen: 1 - Requirements that must be fulfilled : - The diagnosis and prognosis must be certain. - Hopeless and unbearable suffering must be present. - The diagnosis, prognosis, and unbearable suffering must be confirmed by at least one independent doctor. - Both parents must give informed consent. - The procedure must be performed in accordance with the accepted medical standard. O Protocolo de Groningen: 2 - Information needed to support and clarify the decision about euthanasia: (1) Diagnosis and prognosis : - Describe all relevant medical data and the results of diagnostic investigations used to establish the diagnosis. - List all the participants in the decision-making process, all opinions expressed, and the final consensus. - Describe how the prognosis regarding long-term health was assessed. - Describe how the degree of suffering and life expectancy were assessed. - Describe the availability of alternative treatments, alternative means of alleviating suffering, or both. - Describe treatments and the results of treatment preceding the decision about euthanasia. Implementation : - Describe the actual euthanasia procedure (time, place, participants, and administration of drugs). - Describe the reasons for the chosen method of euthanasia.
