5 History and legal framework (III) 1966: the UN s ICCPR and ICESCR provide for the first binding provisions regarding children: Article 24(1) ICCPR: Every child shall have, without any discrimination as to race, colour, language, religion, national or social origin, property or birth, the right to such measures of protection as are required by his status as a minor, on the part of his family, society and the State. Article 10 ICESR: Special measures of protection and assistance should be taken on behalf of all children and young persons without any discrimination for reasons of parentage or other conditions.

6 História e enquadramento legal (III) 1966: o PIDCP e o PIDESC apresentaram as primeiras provisões vinculativas sobre as crianças: Artigo 24º(1) PIDCP: Qualquer criança, sem nenhuma discriminação de raça, cor, sexo, língua, religião, origem nacional ou social, propriedade ou nascimento, tem direito, da parte da sua família, da sociedade e do Estado, às medidas de proteção que exija a sua condição de menor. Artigo 10º PIDESC: Medidas especiais de proteção e de assistência devem ser tomadas em benefício de todas as crianças e adolescentes, sem discriminação alguma derivada de razões de paternidade ou outras.

12 Definition of the child Definição de criança Article 1 CRC: For the purposes of the present Convention, a child means every human being below the age of 18 years unless, under the law applicable to the child, majority is attained earlier. CDC, Artigo 4º: Os Estados Partes comprometem-se a tomar todas as medidas legislativas, administrativas e outras necessárias à realização dos direitos reconhecidos pela presente Convenção. No caso de direitos económicos, sociais e culturais, tomam essas medidas no limite máximo dos seus recursos disponíveis e, se necessário, no quadro da cooperação internacional.

18 Discussion (I) Q: Are there rights that belong to adults that should not belong to children? And vice versa. Q: Are there any groups of rights that are complied with less than others? Why? Q: If rights are not being respected, where does the problem lie? Governments who are breaching the rights Parents Professionals working with children (doctors, teachers, etc.) Are children s rights being breached by default (through lack of awareness or resources), or through active repudiation of those rights? Q: Can it be argued that the CRC cannot achieve progresses due to its lack of real teeth?

20 Discussion (II) Children on the edge of adulthood Both the 1989 Convention on the Rights of the Child and the African Charter for the Rights and Welfare of the Child offer protection to those under the age of 18. In many states, however, young people (between the age of 15-18) are treated as adults in law and practice. Q: Should the UN Committee continue to advocate increases towards 18 years as the age below which children benefit from the Convention? Q: Should children become adults overnight on a specified birthday? Q: What impact might the third Optional Protocol (on communications) have on this?

21 Discussão (II) Crianças à beira da vida adulta Tanto a Convenção sobre os Direitos da Criança quanto a Carta Africana dos Direitos e Bem-Estar da Criança oferecem proteção àqueles menores de 18 anos. Em muitos Estados, no entanto, jovens (entre anos) são tratados como adultos na lei e na prática. P: O Comité da ONU deveria defender o aumento para 18 anos como a idade abaixo da qual as crianças se beneficiam da Convenção?
